Police bait car program lands couple who reported suspicious car in court

By Michael May
Sunday, July 26, 2009

When Mark Douglas Ledford came home on Nov. 29, 2007, to find a strange green Honda Accord parked near his house with the windows rolled down and the keys in the ignition, he suspected trouble.

Who had left the car there, and why? What if something strange was going on? Shouldn't the police investigate?

Soon after, those questions got answered. But instead of helping uncover a crime, Ledford and then-girlfriend Asia Ward found themselves arrested and accused of one.

On Wednesday, according to his attorney, Ledford is scheduled to be tried on charges of auto burglary after having become another statistic in an Austin Police Department undercover program. Ward's trial date has not been set.

Ledford, 39, has a job at a real estate firm and no criminal record. He plays in local rock bands and has a tattoo across his chest that reads "To Whom Much is Given, Much is Required."

Ward is a 21-year-old woman with a punk-rock fashion sense and a fixation with classic zombie movies. She also has no criminal record.

So how did she and Ledford find themselves in this fix? According to them, their attorney and police, here's what happened:

Witnesses Dispute Story In Officer-Involved Shooting [Aug. 3rd, 2009|02:34 am]

(From KTVU - Oakland)

Posted: 10:23 am PDT August 2, 2009Updated: 6:31 pm PDT August 2, 2009
OAKLAND, Calif. -- Investigators at Oakland police are trying to piece together what happened Saturday night when an officer shot and killed an Oakland man she said was armed with a hatchet. Some witnesses and family of the man say he was a neighborhood handyman and carpenter, and was not causing a disturbance.

People came to Tolin's Liquor store on International Boulevard to pay their respects to 46-year-old Brownie Polk Sunday afternoon. Family and friends say he had his carpentry tools with him at the time he was shot, but was not threatening anyone.

“He was not some drunk that was wielding an ax, walking around threatening people,” said Tiffany Townsend. “He didn't do that. He carried tools with him all the time. Your car would be broke on the side of the road and my uncle would see you and help you.”

Around 9 p.m., Polk was inside Tolin's Liquors buying cigarettes. Police say a female officer in the area was flagged down by a merchant saying someone was causing a disturbance in the store.

“You could see her charging her gun at Brownie telling him to put his ax down while he was at the store,” said Tolin’s store employee Riad Elhai. “[The ax] was in his hand facing the floor... She was telling him to put his ax down. He would just tell her, ‘For what? I didn't do nothing'. And when he was trying to walk out the store… that's when she started to shoot the gun at him.”

Police say Polk was shot several times and died from his injuries. Investigators say the officer originally thought Polk was carrying a knife, but it was later determined it was a hatchet. Police say the officer had seconds to make a decision and felt her life was in danger. Store employees say officers took surveillance video that captured the shooting.

“My question is: why not tase him?” said Tracey Bell, a family friend of Brownie. “He didn't have a gun. He didn't have a semi-automatic weapon. Why not tase him? Why not pepper spray him?

A spokesman for the Oakland police said it’s not always possible to pull out a taser when in close proximity to a suspect.

“When you're in a close proximity with that person with a hatchet, it's not feasible to pull out a taser and try to taser somebody,” said officer Jeff Thomason. “Especially if the taser misses, the prongs miss or the taser does not have any effect on the person.”

Store employees claim they never flagged down police and say Polk was not causing trouble. Polk's family is left confused and hurt.

"He was somebody's son, he was somebody' father, somebody's brother, an uncle,” said Townsend. “He is going to be greatly missed.”

Polk leaves behind a 16-year-old son. His mother died just three months ago from cancer so he is now left without parents. Polk's family says they want to get to the bottom of what happened.

"Bitch-ass n****r" is BART police protocol [Jul. 20th, 2009|08:13 pm]
Anti-Cop community

[Current Mood |angryangry]

BART Officer Tony Pirone kneeled on Oscar Grant's Neck and called him a "BITCH ASS N****R" seconds before he was shot in the back by Officer Johannes Mehserle. BART Police Chief Gee watched this on video, and called it "Following protocol and performing his duties in a professional manner".

Yes, this is for real. "BITCH-ASS N****R" are some of the last words Oscar Grant III heard before he was murdered by BART Police Officer Johannes Mehserle on January 1st, 2009. Mehserle is standing trial for murder, and at Johannes Mehserle's pre-trial hearing, half a year after Oscar's murder, a lot more information came to light about what took place on January 1st, 2009. It's information that BART's General Manager and Police Chief have known all along, and have been trying to hide while lying to the public.

Court transcripts show that on January 1st, BART Police confiscated (stole) a high quality video from a passenger. The video captures Pirone's assault on Oscar and his racist slur. The transcripts reveal beyond a shadow of a doubt that Officer Tony Pirone beat Oscar (as well as other passengers), and then kneeled on Oscar's neck while calling him a “BITCH-ASS N****R”, seconds before Johannes Mehserle fired a fatal shot into the young man's back. But to this day, neither Tony Pirone nor any of the other officers who took part or facilitated the attack on Oscar have faced ANY consequences for their roles in his murder.

Instead, BART has attempted to protect Tony Pirone and the other corrupt BART Police Officers. On January 12th, knowing the public did not have access the confiscated video, BART General Manager Dorothy Dugger and Police Chief Gary Gee announced the results of their internal affairs investigation, exonerating ALL of the officers, including Tony Pirone, of any wrongdoing. Chief Gee said, "All of the other officers who responded to the incident at around 2:00 a.m. at the Fruitvale Station followed protocol and they performed their duties in a professional manner". In February, after video taken by witnesses showed Tony Pirone pushing and striking Oscar, Dugger tried yet another manipulation to quell protests from the public. Without consulting our elected officials on BART's Board of Directors, she hired her cronies at the law firm Meyers Nave to perform a second "independent" investigation. On April 3, while the investigation was still in full swing, Dugger instructed BART lawyers to file a legal brief blaming Oscar for his own murder. And it is now July, and although the Meyers Nave investigation was supposed to be concluded by May, Dugger's chosen law firm has yet to deliver any report at all.

Parnell Smith Killed by Oakland Police [Jul. 20th, 2009|08:04 pm]
Anti-Cop community

On July 15, Parnell Smith became the most recent murder victim of the Oakland Police.

What follows is the corporate news account. It should be noted that, even though KGO-TV reports right in the story's teaser that the person whom the police killed was a "rape suspect," they confirm right within the article that he's not suspected of any such thing. But that's the news, for ya.

OAKLAND, CA (KGO) -- Questions are being raised about what really happened during a running gun battle between one man and police on the streets of Oakland on Wednesday. Witnesses say officers shot and killed an unarmed man. The suspect was a fugitive parolee and rape suspect.

Police said they stopped Parnell Smith because they believe he matched the description of a rape suspect. They both even carried walking canes. However, now they have confirmed he was not the right person. They now have a name for the actual rape suspect. Two officers are now on paid leave because of the shooting.

BART ex officer on trial. [Jun. 4th, 2009|11:15 pm]

I wondered what was going on. I hope to heck they find him guilty. I don't see how they cannot. The video shows him shooting Grant in the back. *Warning* if you haven't see the video, it's graphic. It's not often you see murder captured on camera.
